Can you stop foreclosure and save your home? The answer to that question will depend on a number of things. However, if you can get to an attorney before the foreclosure actually occurs, you stand a good chance of being able to stop the foreclosure. Even so — the sooner you talk to an attorney, the better those chances will be.

If you are less than 90 days behind on your mortgage payments, have significant equity or own a multifamily dwelling — you may be able to use the equity to stop foreclosure on the home. A third option is the "cram-down." If you have the assets available to do it and you owe more on your home than it is worth, a cram-down will allow you to pay the actual value of the home in full rather than the amount you owe. If you are more than 90 days behind, do not have much equity in the home and cannot do a cram-down — then Chapter 13 will likely be your best option.
